restrictive measures

Restrictive measures and travel bans issued by the Council of the European Union or by the United Nations. The Member State holding the Presidency of the Council of the European Union is responsible for entering alerts based on all Union restrictive measures and UN travel bans adopted under its Presidency.

Return

The process of a third-country national going back - whether in voluntary compliance with an obligation to return, or enforced - to:

  • His or her country of origin; or
  • A country of transit in accordance with Community or bilateral readmission agreements or other arrangements; or 
  • Another third country, to which the third-country national concerned voluntarily decides to return and in which he or she will be accepted.
Return decision

An administrative or judicial decision or act, stating or declaring the stay of a third-country national to be illegal and imposing or stating an obligation to return.

Revoke short stay or visa

The data to be added where an authorisation for short stay or visa is revoked, meaning that is no longer effective.

Right to mobility

The EES is not applicable to third-country nationals exercising their right to mobility:

  • Third-country nationals and of their family members in the framework of an intra-corporate transfer;
  • Third-country nationals, and where applicable their family members, for the purpose of research, studies, training or voluntary service in the European Voluntary Service, and where Member States so decide, pupil exchange schemes or educational projects, voluntary service other than the European Voluntary Service or au pairing.
Right to remedy

The third-country nationals have the right to an effective remedy, having the right to bring an action or a complaint before the competent authorities or courts of that Member State which refused the right of access to, or right of rectification, completion or erasure of data. It also applies in cases where requests for access, rectification, completion or erasure were not responded to within the deadlines or were never dealt with by the Data Controller.
